No parent wants to risk his/her own kids’ life by the other road users and if something wrong happens parents are to be blamed equally for the accidents. It has become important for the parents that children should be properly tightened with the safety harnesses, crash helmets and to avoid driving beyond the speed of 40kmph.
In a move to strengthen road safety for children also, the Center has made it mandatory to wear a safety harness and crash helmet for children below 4 years being carried on a two-wheeler with a restricted speed limit of 40 kmph. These rules will come into force from 15 February 2023. In a notification issued on February 15, The Ministry of Road Transport and Highways, has amended Rule 138 of CMVR, 1989 and has prescribed norms related to safety measures for children below four years of age, riding or being carried on a motorcycle. This has been notified under Section 129 of the Motor Vehicles Act, which mandates that the Central Government may, by rules, provide for measures for the safety of children below four years of age, riding or being carried on a motorcycle. Further, it specifies use of a safety harness and crash helmet. It also restricts the speed of such motorcycles to 40 kmph.
Further, the rules specify that the speed of the motorcycle with the child up to age four years should be restricted to 40 kmph. The ministry had come up with a draft notification for these rules in October last year. The government announced that Section 129 of the Motor vehicles Act had been amended by the Motor Vehicles (Amendment) Act 2019. These rules will come into force after one year from the date of publication of the Central Motor Vehicles (Second Amendment) Rules, 2022.
